SpeedTest Pro provides a free internet speed testing service that measures your download speed, upload speed, ping latency, and jitter. The Service is provided "as is" for informational purposes.
3. Use of Service
You agree to use the Service only for lawful purposes. You may not:
- Use the Service to violate any applicable laws or regulations
- Attempt to interfere with or disrupt the Service
- Use automated scripts or bots to access the Service excessively
- Attempt to gain unauthorized access to our systems
- Use the Service to conduct denial-of-service attacks
- Misrepresent your identity or affiliation
- Resell or commercially exploit the Service without permission
4. Accuracy of Results
While we strive to provide accurate speed test results, many factors can affect your test including network congestion, device capabilities, WiFi interference, and server availability. Results are estimates and should not be considered definitive measurements. We are not responsible for any decisions made based on test results.
5. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by SpeedTest Pro and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.
6. Third-Party Links and Advertising
Our Service may contain links to third-party websites and display advertisements. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your interactions with advertisers are solely between you and the advertiser.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPEEDTEST PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD.
9. Indemnification
You agree to indemnify and hold harmless SpeedTest Pro and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
10. Modifications to Service
We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may also update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
11. Termination
We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SpeedTest Pro operates, without regard to conflict of law principles.
